Cleansly Provider Terms
These Service Provider Terms (“Provider Terms”) govern your participation as a cleaning service provider using the Cleansly platform (“Platform”).
By registering or accepting customer referrals through Cleansly, you agree to these Provider Terms.
1. Independent Contractor Relationship
You acknowledge and agree that you operate as an independent contractor and not as an employee, partner, agent, or representative of Cleansly.
You are solely responsible for:
- Providing cleaning services to customers
- Setting pricing and service delivery methods
- Maintaining business registrations, licences, and certifications
- Complying with Australian taxation obligations including GST where applicable
- Superannuation, workers compensation, and employment obligations for your staff or subcontractors
2. Service Standards
Providers must:
- Deliver services with reasonable care and skill
- Attend bookings punctually
- Maintain professional conduct with customers
- Use safe and appropriate cleaning products and equipment
- Comply with all applicable Australian workplace health and safety laws
- Comply with all relevant state and territory regulations
3. Cleaning Service Scope and Service Types
Cleansly provides customers with predefined cleaning service categories, including but not limited to:
- Standard Cleaning
- Deep Cleaning
- Vacate / End-of-Lease Cleaning
Each cleaning category includes a defined service checklist communicated to customers via the Platform.
Providers agree that when quoting or performing services they must:
- Review and understand the service scope associated with the selected cleaning type
- Quote services inclusive of all required checklist items
- Perform services consistent with Cleansly service standards
- Not exclude required items unless agreed in writing with the customer
Cleansly may update service categories or checklists periodically. Providers must comply with the current service scope published on the Platform.
Failure to comply with service scope requirements may result in remediation requests, customer refunds, or removal from the Platform.
4. Insurance and Licensing
Providers must maintain all legally required insurance coverage, including public liability insurance appropriate for cleaning services.
Cleansly may request proof of insurance at any time.
5. Customer Relationships
Providers are responsible for:
- Managing service bookings and communications
- Service delivery and customer satisfaction
- Handling complaints, disputes, or refund requests
6. Payments and Platform Fees
Cleansly may charge referral fees, subscription fees, or other platform fees which will be disclosed separately.
Unless otherwise stated, providers are responsible for invoicing and collecting payment from customers.
7. Prohibited Conduct
Providers must not:
- Provide misleading or false business information
- Engage in unlawful or deceptive conduct
- Harass or endanger customers
- Misrepresent affiliation with Cleansly
- Violate Australian Consumer Law
8. Platform Use and Monitoring
Cleansly reserves the right to monitor provider activity and customer feedback to maintain service quality.
9. Suspension or Removal
Cleansly may suspend or remove providers from the Platform where reasonably necessary, including where:
- Customer complaints are received
- These Terms are breached
- Unsafe or unlawful conduct occurs
- Required insurance is not maintained
10. Limitation of Liability
Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot be excluded under the Australian Consumer Law.
To the extent permitted by law, Cleansly excludes liability for indirect or consequential losses including:
- Loss of business revenue
- Loss of opportunity
- Reputational damage
Where liability cannot be excluded, Cleansly’s liability is limited to resupplying the Platform services or payment of the cost of resupply.
11. Indemnity
Providers agree to indemnify Cleansly against any claims, damages, liabilities, or expenses arising from:
- Services performed by the provider
- Personal injury or property damage caused by the provider
- Breach of these Terms
- Violation of laws or third-party rights
12. Changes to Provider Terms
Cleansly may update these Terms periodically. Continued use of the Platform constitutes acceptance of updated Terms.
13. Governing Law
These Provider Terms are governed by the laws of Australia and the State or Territory in which Cleansly operates, and providers submit to the jurisdiction of Australian courts.
